These terms cover your use of this website. They're written to be read, so please do.

1. About these terms

This website is operated by Issayah Maxwell-Kjestrup trading as Elevate Wrk (ABN 12 923 400 781), referred to here as "Elevate Wrk", "we" or "us". By using the website you agree to these terms. If you don't agree, please don't use the site.

2. General information only

The website describes our services in general terms. It isn't professional, legal, financial or business advice for your situation. We work to keep it accurate and current, but it may contain errors or become out of date, so please check with us before relying on anything on it.

3. The examples on this site are fictional

Corner Grind (and "Corner Grind Coffee") and Maple & Main are made-up businesses we use to show the kind of work we do. Their names, logos, mockups, web addresses and people are invented. Any resemblance to a real business or person is a coincidence.

The figures shown in those examples, such as likes, followers, ratings, directions requests and email opens, are illustrative only. They aren't results we've achieved for a client and they aren't a promise or prediction of results for your business. Real results depend on many things outside our control.

4. "Try your name on" sketches

The brand sketch on our home page is generated automatically in your browser for illustration. It isn't a finished design and isn't a deliverable. We don't check whether a name, web address or social media handle shown in a sketch is available, or whether it might conflict with someone else's trade mark or business name. Please don't treat a sketch as advice about using a name. We recommend searching the ASIC business names register and IP Australia's trade mark database, and getting advice, before you adopt a name.

5. Booking a call

• The strategy call is free and comes with no obligation to buy anything.
• Sending the booking form is a request. A call is only booked once we confirm it with you. We may suggest another time, and we may decline a request.
• Please only give details that are yours, or that you're authorised to give.
• We only provide services under a separate written proposal or agreement that sets out the scope, price and terms. Nothing on this website is an offer that you can accept to form a contract.
• Prices on this website are the starting price for the scope each package describes. Your written proposal confirms the final scope and price before you pay anything. Monthly plans can be cancelled with 30 days’ notice and have no lock-in period.

6. Intellectual property

The content of this website, including its text, design, graphics, illustrations, code and the Elevate Wrk name and logo, is owned by us or used under licence. You may view and share pages for your own personal, non-commercial use. You may not copy, reproduce, adapt or republish the content for commercial purposes without our written permission.

The fonts on this site are used under the SIL Open Font License, and the animation libraries are used under their own licences. Those licences belong to their authors and aren't changed by these terms.

7. Using the site properly

You agree not to misuse the website. That includes trying to gain unauthorised access to it or the systems behind it, interfering with how it works, introducing malicious code, sending spam or automated submissions through the form, or using the form to send false information or someone else's details without their permission.

8. Availability and links

We may change, suspend or remove any part of the website at any time. Where the website links to another site, we're not responsible for that site's content or privacy practices.

9. Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that can't lawfully be excluded, restricted or modified.

10. Limits on our liability

Subject to clause 9, and to the extent the law allows:

• the website is provided "as is", and we exclude all warranties and conditions about it that aren't set out in these terms; and
• we aren't liable for any loss or damage arising from your use of, or inability to use, the website or its content, including indirect or consequential loss.

Where the law implies a guarantee that can't be excluded but allows our liability to be limited, our liability is limited, at our option, to supplying the relevant information or service again, or paying the cost of having it supplied again.

11. Privacy

Our Privacy Policy explains how we handle personal information collected through this website.

12. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that can hear appeals from them.

13. Changes to these terms

We may update these terms from time to time by publishing a new version on this page. The version on this page when you use the website is the one that applies.
